Hohfeld’s analysis on the different types of rights and duties is highly influential in analytical legal theory, and it is considered as a fundamental theory in AI&Law and normative multi-agent systems. Yet a century later, the formalization of this theory remains, in various ways, unresolved. In this paper I provide a formal analysis of how the working of a system containing Hohfeldian rights and duties can be delineated. This formalization starts from using the same tools as the classical ones by (...) Kanger and Lindahl used, but instead of focusing on the algebraic features of rights and duties, it aims at providing a comprehensive analysis of what these rights and duties actually are and how they behave and at saying something substantial on Power too—maintaining all along the Hohfeldian intentions that these rights and duties are sui generis and inherently relational. Malpractice issues in psychotherapy and psychological treatments refer to the unethical behavior of a psychologist or psychotherapist toward the patient. The current study reviewed complaints directed at psychologists and psychotherapists in Sweden with regard to possible incidents of malpractice. Eligible cases were retrieved from a database managed by the Health and Social Care Inspectorate [Inspektionen för vård och omsorg (IVO)], an administrative authority responsible for the safety and quality of healthcare and social services delivery. These cases were analyzed using thematic (...) analysis. In total, 33 complaints matched the keywords proposed by IVO, and were scrutinized in detail. The cases primarily involved psychiatric care by a psychologist in outpatient settings, although many cases comprised multiple healthcare providers responsible for the patient’s care, or targeted the healthcare unit as a whole. The results demonstrated that different forms of malpractice occur, and can be classified in two general themes, Incorrect administration and implementation and Attitude and behavior, which involve organizational aspects as well as examples of malpractice and unethical behavior. Implications for clinical practice and future research include further training in ethics and malpractice, video recording or auditing sessions, routine outcome monitoring, and providing patients with information on how to file complaints. Tracing this intertextuality from the Socratic authors to Boethius, the book shows how Greek and Roman protreptics define philosophy as a revisionary form of education, articulate the ultimate goals of this education, and associate their authors and audiences with philosophy as a new discursive practice and a new way (...) of living. This collection presents the English-language reader for the first time with essays that are representative of Bernstein's much-neglected revisionist period, 1901-1921. Bernstein himself suggested that this later work included significant new elements, indicating further progress in his liberal-socialist theory. Bernstein's later work acquires additional significance in light of the events of 1989, which have discredited not only Marxism-Leninism, but revolutionary Marxist theory in general, thus making the reevaluation of Bernstein's revisionism a worthwhile experience.

Und bekanntlich heisst es demgegenüber in den Ideen von 1913: "Unter den allgemeinen Wesenseigentümlichkeiten des tran szendental gereinigten Erlebnisgebietes gebührt eigentlich die erste Stelle der Beziehung auf das,reine' Ich",3 und revidiert Husserl in der zweiten Auflage der Logischen Untersuchungen von 4 1913 seine Stellungnahme zur Frage des reinen Ich. Weniger bekannt ist bisher, wie Husserl auf seinem Denkweg von der einen zur anderen Stellungnahme zum Problem des Ich gekommen ist. Was bewegte ihn, das "Ich" in die phänomeno logische Problematik einzubeziehen? Zu vermuten war, dem Wandel in der Stellung zum Problem des Ich liege ein Wandel im Verständnis der Phänomenologie selbst zugrunde. Welche Phänomene motivierten, auf dem phänomenologischen Boden selbst, die Einbeziehung des Ich? Vor allem dieser Frage gehen wir, unter Berücksichtigung des Nachlassmaterials des Husserl Archivs (Leuven), in unserer Studie nach. (shrink)

Measuring and assessing the different aspects of gambling behavior and its consequences is crucial for planning prevention, treatment, and understanding the development of at-risk and problem gambling. Studies indicate that instruments measuring problem gambling produce different results based on the characteristics of the population assessed. To accurately measure at-risk and problem gambling behavior, especially in a low-risk population, measures must cover a wider set of dimensions than the negative consequences already manifest. The Jonsson-Abbott Scale includes items that cover overconsumption, actions (...) that reinforce gambling behavior, and belief in gambling fallacies, based on a three-factor structure and has previously demonstrated good psychometric properties. However, there is a need to investigate how the instrument also functions in low-risk populations. This study aims to do so using both confirmatory factor and Rasch analysis; this research included 1,413 Swedish participants who endorsed at least one JAS item. The results replicated the previous three-factor solution and indicated that the instrument had good reliability. In addition, the results demonstrated that the three factors are independent, and the overall score per factor needs to be analyzed. In summary, the JAS appears suitable for use in low-risk populations to measure various aspects of gambling behavior. (shrink)

Dass in ihr das Risiko grundgelegt ist, das in jeder Begegnung eingeschlossen ist? Dass sie das Netz ist, das jede menschliche Liebe unterfangt? Und dass sie schliesslich die ausserste Spannung auszieht, von der Fulle des Seins zum Nichts und zum Tod? Plotzlich ruckt dann die Dreifaltigkeit mitten ins Zentrum des Verstehens von Menschheitsentwicklung und Kultur, von Gottinnigkeit ebenso wie von Gottesferne. Nichts Geringeres unternimmt die vorliegende (...) Arbeit des Franziskaners P. Eduard Prenga. Den wesentlichen Bezugspunkt bildet dabei der italienische Theologe Piero Coda, der an der Papstlichen Lateran-Universitat sein Lehrer war. Der Mensch in seiner Geschichtlichkeit ist das Ziel der sich schenkenden Liebe Gottes, so wie sie im Neuen Testament bezeichnet wird: agape. Deshalb offenbart dieser sich selbst. Diese Offenbarung stellt die Theologie vor die Frage: Wie kann die Dreieinigkeit gedacht und ins Menschliche "uber-setzt" werden? Die vorliegende Studie unternimmt den Versuch einer Antwort, indem sie vom trinitatstheologischen Denken des italienischen Theologen Piero Coda ausgeht und zu Edmund Husserls Phanomenologie der Intersubjektivitat und Interpersonalitat gelangt. This paper critiques Rothbard’s concept of gross investment. Rothbard introduced the concept in order to demonstrate his point that it is not consumer spending that primarily drives the economy, like the mainstream Keynesian view maintains, but the capitalists’ spending. In this paper, it is argued that, contrary to Rothbard’s opinion, the amount of gross investment as he defines it does not contain significant information concerning the question as to whether the capital structure of a society can be upheld or not. (...) Instead, it is an arbitrary figure that depends on the length of the different stages of production. This problem has not been recognized by Rothbard because his exposition rests upon the assumption of an equal time length for all stages. Apparently, he has been led astray by his intention to find arguments against the importance of consumer spending in the determination of output. (shrink)

Procrastination refers to voluntarily postponing an intended course of action despite expecting to be worse off for this delay, and students are considered to be especially negatively affected. According to estimates in the literature, at least half of the students believe procrastination impacts their academic achievements and well-being. As of yet, evidence-based ideas on how to differentiate severe from less severe cases of procrastination in this population do not exist, but are important in order to identify those students in need (...) of support. The current study recruited participants from different universities in Sweden to participate in an anonymous online survey investigating self-rated levels of procrastination, impulsivity, perfectionism, anxiety, depression, stress, and quality of life. Furthermore, diagnostic criteria for pathological delay as well as self-report items and open-ended questions were used to determine the severity of their procrastination and its associated physical and psychological issues. In total, 732 participants completed the survey. A median-split on the Pure Procrastination Scale and the responses to the PDC were used to differentiate two groups; “less severe procrastination”, and “severe procrastination”. For participants in the severe group, 96–97% considered procrastination to a problem, compared to 42–48% in the less severe group. The two groups also differed with regard to considering seeking help for procrastination, 35–38% compared to 5–7%. Participants in the severe group also reported more problems of procrastination in different life domains, greater symptoms of psychological issues, and lower quality of life. A thematic analysis of the responses on what physical issues were related to procrastination revealed that these were characterized by stress and anxiety, e.g., tension, pain, and sleep and rest, while the psychological issues were related to stress and anxiety, but also depression, e.g., self-criticism, remorse, and self-esteem. The current study recommends the PPS to be used as an initial screening tool, while the PDC can more accurately determine the severity level of procrastination for a specific individual. (shrink)

A reproducibility principle is formulated and adopted as the guiding criterion for the acceptance of an experimental procedure as a simultaneous measurement of several observables. It is pointed out that this criterion can be applied to classical as well as quantum physics, and that it incorporates compatible as well as incompatible observables. The concept of fuzzy probability measure is presented as a possible mathematical tool for the description of statistical processes involving measurements of incompatible observables.

A notion of quantum space-time is introduced, physically defined as the totality of all flows of quantum test particles in free fall. In quantum space-time the classical notion of deterministic inertial frames is replaced by that of stochastic frames marked by extended particles. The same particles are used both as markers of quantum space-time points as well as natural clocks, each species of quantum test particle thus providing a standard for space-time measurements. In the considered flat-space case, the fluctuations in (...) coordinate values with respect to stochastic frames are described by coordinate probability amplitudes related to irreducible stochastic phase space representations of the Poincaré group. Lagrangian field theory on quantum space-time is formulated. The ensuing equations of motion for interacting fields contain no singularities in their nonlinear terms, and therefore can be handled by methods borrowed from classical nonlinear analysis. (shrink)

It is shown that the time operatorQ 0 appearing in the realization of the RCCR's [Qμ,Pv]=−jhgμv, on Minkowski quantum spacetime is a self adjoint operator on Hilbert space of square integrable functions over Σ m =σ×v m , where σ is a timelike hyperplane. This result leads to time-energy uncertainty relations that match their space-momentum counterparts. The operators Qμ appearing in Born's metric operator in quantum spacetime emerge as internal spacetime operators for exciton states, and the condition that the metric (...) operator should possess a ground exciton state assumes the significance of achieving minimal spacetime4-momentum uncertainty in fundamental standards for spacetime measurements. HEINRICH SCHIPPERGES vollendete am 17. Marz 1983 sein 65. Lebensjahr. Urn ihm eine Freude zu machen, ja urn ihm die gebiihrende Referenz zu erweisen, hatte sich am 19. Marz im Auditorium der Heidelberger Akademie der Wissenschaften ein Kreis von Gratulanten eingefun­ den. Die Sprecher brachten ihre Gabe, je einen Beitrag aus dem eigenen Arbeitsgebiet, zum Vortrag, und der lubilar selbst griff in die Speichen. Er zeigte, was er unter "An­ thropologie" versteht. Nicht aIle Beitdige zu diesem Buche konnten miindlich ausgebreitet (...) werden, aus auBeren Grunden. Nicht alles, was gesagt wurde, konnte gedruckt werden, aus ganz verschiedenen sachlichen Grunden. Es ist nur natiirlich, daB in unserem Buche die historischen Aspekte iiberwiegen. Andererseits geht es gewiI3 nicht nur urn "Geschichte" und "Problemgeschichte", sondern urn klarende und kritische Untersuchungen zum Stand der "Hildegard-Forschung", zum Krankheits-, zum ModeIlbe­ griff, urn Gestalttheorie und Krankheitsforschung, - urn nur einiges zu nennen. Die Darstellung unserer "Aspekte" bringt, wie ich denke, zwei Kostbarkeiten: den Bericht der ehrwiirdigen Frau Sr. ADELGUNDIS FUHRKOTIER OSB iiber die Frage, was ist gesichert im literarischen Nachlaj3 der hI. Hildegard von Bingen, und die bezaubernde Geschichte der Vorwor­ ter der Dedikationsliteratur des 12. bis 17. sc. durch einen der besten Kenner des Prooemium, den lubilar selbst. Unser Buch enthalt elf wissenschaftliche Beitrage und eine bibliographische Materialsammlung zur Medizinischen Anthropologie. Dieser Beitrag will dem, der sich orientie­ ren muB, was diese Anthropologie darstellt und wie sie ge­ worden ist, einen "Handapparat" geben. (shrink)
